DPG (including M2 Payment Solutions Inc) complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. Data Privacy Framework (UK Extension to the EU-U.S. DPF), and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce, and subject to the investigatory and enforcement powers of the Federal Trade Commission (FTC). Therefore, any failure to comply is enforceable by FTC.

M2 Payment Solutions Inc has certified to the U.S. Department of Commerce that it adheres to:

  • the EU-U.S. Data Privacy Framework (EU-U.S. DPF) Principles, which apply to the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF with regard to the processing of personal data received from the European Union and from the United Kingdom (and Gibraltar), and
  • the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) Principles, which apply to the Swiss-U.S. DPF with regard to the processing of personal data received from Switzerland.

What Information Does DPG Collect?

The type of information that we collect and retain depends upon your interaction with our Site. In general, there are two different categories of information we may collect:

Non-Personal Data

Non-Personal Data refers to information that cannot be used to identify a specific natural person. The data DPG may collect include, without limitation, the internet address of the website from which you link directly to our website, the name of the file or the words you search, and the browser you use to access our website, type of device, device name, location of the device, language, technical parameters and manufacturer of a device).

We do not collect any Personal Data automatically on digitalpayments.group website.

DPG does not collect your Sensitive Personal Data.

Nevertheless, should DPG ever start collecting Sensitive Personal Data, we will inform you duly upfront, and ask for your affirmative express consent (opt-in) if such information is to be (i) disclosed to our third party agent or (ii) used for a purpose other than those for which it was originally collected or subsequently authorized by you through the exercise of opt-in choice.

If legally compelled to disclose your information to a third party, we will use commercially reasonable efforts to notify you in advance of a disclosure unless legally prohibited.

DPG uses third party agents to provide services to DPG and to you – either directly or indirectly. These third party agents are under contract with DPG ensuring an adequate level of Personal Data protection.

Specifically, we use these third party agents for the purpose of verification of your identity and authorization to act on behalf of the enquiring prospective customer (legal entity), and to fulfil applicable legal, regulatory and card scheme requirements (e.g., anti-money laundering rules, economic and international sanctions application). Your Personal Data under these arrangements is not disclosed nor transferred to such third party agents, and this processing only allows us to provide you with our services while fulfilling all above-mentioned requirements. Nevertheless, should we in the future choose to transfer your Personal Data to a third party acting as an agent on our behalf:

  1. DPG shall remain liable under the DPF Principles if our agent processes your personal data in a manner inconsistent with the DPF Principles, unless we can prove that we are not responsible for the event giving rise to the damage;
  2. DPG will offer you the opportunity to opt out from such data transfer.

Rights and Responsibilities

If you have given your Personal Data to DPG for the purpose of providing you with products or services, you have the right to ask us to advise you of the scope of information DPG processes about you, the purpose and nature of the processing, and information on who we share it with.

If you have given us your Personal Data, you can also request to update, correct, delete (assuming that this does not impact the services we are providing to you), or take it elsewhere at any time.

If DPG aims to use your previously collected Personal Data for a purpose that is materially different from the purpose for which it was originally collected or subsequently authorized by you, DPG will inform you and you will be provided with the opportunity to refuse (opt out from) the processing of your Personal Data for that new purpose.

If you are concerned about potential violation of your privacy rights in conjunction with DPG website, please advise us of your concerns and we will strive to resolve them as soon as practically possible.

While we will strive to accommodate your requests, we may reject requests which risk the privacy of others, are unreasonable or repetitive, require disproportionate technical effort (such as developing new systems or fundamentally changing an existing business practice), or would be extremely impractical. Where we can provide information access and correction, we will do so for free, except where it would require a disproportionate effort. We aim to maintain our services in a manner that protects information from accidental or malicious destruction. Because of these reasons, after information is deleted from our services, we may not immediately be able to remove residual copies from our active servers and may not delete information from our backup systems.

In compliance with the EU-U.S. DPF Principles (which apply to the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF), and the Swiss-U.S. DPF Principles (which apply to the Swiss-U.S. DPF), DPG commits to resolve complaints about your privacy and our collection or use of your personal information transferred to the United States, pursuant to these DPF Principles. European Union, Swiss and United Kingdom individuals with DPF inquiries or complaints should first contact DPG at compliance@digitalpayments.group 

DPG has further committed to refer unresolved privacy complaints under the DPF Principles to an independent dispute resolution mechanism, Data Privacy Framework Services, operated by BBB National Programs. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit https://bbbprograms.org/programs/all-programs/dpf-consumers/ProcessForConsumers  for more information and to file a complaint. This service is provided free of charge to you.
